Jason Graybill DBA Graybill Construction

This site is used to remind people to educate themselves before making any contract decision.

We entered a contract with Jason Graybill DBA Graybill Construction for a construction project.

The project was never completed and what was done required repair within months. We have not been able to obtain any warranty work - let alone get the job completed.

Our telephone calls are not answered, voice mail messages are not returned (usually the mailbox is full and a message can't be left), and emails are no longer returned. We were "promised" a site visit a particular time period in April 2010 via email - of course this promise was not met - no phone calls, no emails, no site visits.

Educate Yourselves before entering into a contract any person and/or organization!

Division of Corporations, State Records and Uniform Commercial Code • New York State Department of State

Filing a Certificate of Assumed Name

Purpose: Corporations, limited partnerships, and limited liability companies are required by statute to conduct activities under their true legal name. If a corporation, limited partnership, or limited liability company desires to conduct activities under a name other than its true legal name, a certificate complying with Section 130 of the General Business Law must be filed with the New York State Department of State. All other entities such as general partnerships, sole proprietorships, and limited liability partnerships file an Assumed Name Certificate directly with the county clerk in each county in which the entity conducts or transacts business.

At the time of this posting we searched the Monroe County's database  - where the work was performed and the transaction took place - brought up no DBA records for Jason Graybill.

http://publicrecords.onlinesearches.com/NY_Monroe.htm

Searching the NYS Corporation & Business Entity Database - http://www.dos.state.ny.us/corps/bus_entity_search.html - brings up nothing for the entire state.

We asked for proof of insurance and we were given a copy of an Insurance Binder that had expired October 23, 2009? (our project started in November of 2009)

The binder #1925 had been issued by:

Dryden Mutual Insurance Company

The Agency used was:

Floss Agency Inc.
PO Box 370 6465 Transit Road
East Amherst, NY 14051
716-688-5115

We were aware of a "F" rating with the Better Business Bureau before we entered into the contract - this was based on a "Failure to respond" to a "service issue".

We felt that some people deserve a "second chance"..... and entered in the contract with Jason Graybill dba GrayBill Construction.

Here is the link to the Better Business Bureau report:

http://www.bbb.org/upstate-new-york/business-reviews/home-improvements/graybill-construction-jason-graybill-in-kendall-ny-185435479/

Note there are addresses listed at the BBB that are different than what was noted in our contract:

16020 Carr Rd Kendall, NY 14476 and 13701 W Barre Rd Albion , NY 14411

The BBB now reports that they believe the business is closed as letters that have been sent have returned unopened.

Related to above - the letters that the BBB report are being returned have been mailed to the Albion address, which we found this information:

There appears to be an issue with Jason Graybill T/A Graybill Constructions and the New York State Division of Labors Standards as well:

The original to above can be viewed here: http://www.labor.ny.gov/pdf/Orders%20to%20Comply/Orders%20Issued%20Weekending%206-25-10.pdf

It appears there may be a Hamlin, NY address as this appeared in a local newspaper and on their website:

Jason Ross Graybill, 26, of Victor Lane, Hamlin, was arrested on a Monroe County bench warrant.
was reportedly a passenger in a vehicle stopped for an alleged traffic violation when he was identified and the warrant was discovered.

Not 100% sure this is the same person but the age does match the age posted on the same Jason Graybill's MySpace page: http://www.myspace.com/174835373 that did the work at our location.

Again this site should be used to remind people to educate themselves before making any contract decision.

We believe that the public information we have found shows the "character" of the party we have been involved with.

At this point we have a job that is not complete and what was completed needs warranty service. We have also had to spend additional funds for a cleanup job that was supposed to be done by Graybill Construction.
Jason Graybill DBA Graybill Construction does have the ability, and the option, to make things right - we would consider any solution they have to offer which could include fixing the work previously attempted, finishing the entire job as per the original terms, monetary compensation, or another mutually agreed upon solution. Upon completion of a satisfactory solution to this issue we will update the BBB and even transfer this domain to Jason Graybill DBA Graybill Construction.

In the future we will be adding pictures of the before, during, and current state of the jobsite.

We will also be glad to share any information we can - we have copies of the contract(s), insurance binder, and emails. We can even set up a jobsite visit for those interested.
